Case Evaluation
Engaging counsel and their clients deserve an early and honest opinion of the viability of the case.
Statute and case law, in most jurisdictions, is often less than illuminating in determining the level of duty owed by an agent or broker in the insurance transaction. In defense and plaintiff work, the facts often dominate the controversy. Generally, the facts are best understood from the perspective of the day-to-day work of agents and brokers and their communications with their insureds.
For this reason, it is my practice to delve deeply into the communications in the case file and leave the statute and case law to the engaging counsel.
Expert Testimony
My case history is enumerated on my cases page. It includes work for both defense and plaintiff counsel.
Fact Case Research
In addition to the traditional roles of an expert witness, I can assist in the gathering of facts at any stage of the process. This is more economical than assigning this task to counsel. If requested, I can make recommendations for discovery and offer some suggested deposition questions. Although the analogy is not perfect, this is rather like a criminal lawyer using a detective to investigate the crime. This can be helpful to any lawyer, but particularly those who do not specialize in insurance breach of duty cases.
Initial Consultation
The initial consultation, offered at no charge, includes a general review of the issues and fact pattern of the case and a broad summary of the opinions that I am likely to develop when the full review is completed.
Point Of Engagement
The point of engagement should be determined during the initial consultation. It is strongly recommended that this take place at, or shortly after, the initial case evaluation.
There are several reasons for this. I have been engaged in several cases in which my work would have been more effective had I been part of the process from the beginning. In those cases, the client would have been better and more economically served.
Independent Risk Analysis
Being an expert witness is a great way to learn from other people's mistakes. It enables me to offer proactive, independent consulting services for businesses, NFP organizations, and individuals who do not have a professional risk manager on staff.
